LIP Bled, d.o.o. is collecting, upon the user approval, various data about the visitors to the websites listed above, in order to identify the users. The data is collected and used as further described below

LIP Bled, d.o.o. is collecting personal data from the Website – as long as the user voluntarily submits such data through the use of the web forms on the Website or by subscribing to our newsletter or other forms of e-notices meant for business and marketing communications with the users.

We store your data based on the legitimate interest of the LIP Bled company to process and use your data with a purpose of further communication with you.

The purpose of data processing

Fulfillment of the rights and obligations from the submitted enquiries and/or signed contracts

In the framework of selling/buying of the products and stemming from its contractual obligations, LIP Bled,d.o.o. is processing the personal data of users in order to identify the individuals for the purpose of contract execution (the contract for sale of the products between the LIP Bled,d.o.o. and the customer is based on the submitted enquiry, which can be modified from its original in the process of negotiations also outside of the Website). It is therefore considered that the processing of personal data has a legal basis for the purpose of contract conclusion.

In case of the purchase of the product, the personal data is processed for different purposes, such as communication with the purchaser regarding the order execution, problem resolution (claims, warranty), notifications to the purchaser about the order processing and delivery or other notifications required by law for the order execution, for possible collection purposes and for the purposes of accounting and taxes.

Customers, interested parties and their associates, management and other employees

Your personal data is processed by LIP Bled, d.o.o. for the following purposes:

• Establishing the business relationship, its administration and fulfillment
• Improving existing relationships with customers or building the relationship with new customers or addressing the stakeholders, inclusive the information about current developments and trends in legal field and in our marketing department.

When we collect the information directly from you, it is understood that you submitted the information voluntarily. In principal, we cannot fulfill your order correctly if we don’t have your personal information.

Suppliers

Your personal data is processed exclusively to determine, administer and fulfill our business relationship. This includes archiving of your invoices in our bookkeeping system as well as any other data necessary for bookkeeping and payment processes. Your data is used exclusively for the contract execution, responses to your enquiries or claims, for bookkeeping purposes and technical administration.

Employment candidates

Your data is stored electronically and is used exclusively for administration of your employment application and in case when in the future there may a job opening, for which you are qualified based on your application, we may find you and contact you either by e-mail, regular mail or phone.

Communication with users

• For the purpose of direct marketing – e-mail messages containing useful, educational, interesting or important information from the administrator (information about new offers, promotions, invitations to events, participation in drawings and competitions, useful tips for users etc.)
• For re-marketing purposes (Google, Facebook, Iprom) providing the better and more relevant user information and for improving a degree of user engagement
• For market analyses and customer segmentation for tailored offers about products and services

Based on your submitted personal data you may receive the customized information or offers via email to the email address you submitted or as a printed material to your submitted physical address.

User activity analysis 

• User segmentation and profiling with the goal of personalized and more relevant information in communication and achieving higher responsiveness to email messages
• Analyzing the reading of email messages, particularly which email you opened or didn’t open, which links you clicked (the content you’ve read or viewed), time you spent reading or viewing a particular content etc.
• The website can automatically collect data about the hardware and software from the user’s computer as well as some personal data, like IP address. The personal data collected by your visiting the Website is not stored or it’s stored in the anonymous form and as such, not correlated to the users. These data is used by the Google Analytics whereby the company Google LLC is a data processor within a scope of the legally permitted data processing.

The information is used strictly for preparation of general statistics about the Website use. The data is collected through the use of cookies. Use, management and deletion of cookies is described further in the chapter about cookies policy.

Data processing

Administrator is processing the data based on the law and its lawful interest, unless the interest and basic rights and freedoms of the user to whom the personal data is related, and should as such be protected, prevails. In the scope of its lawful interest, the administrator shall always exercise its judgement based on the current law. The further use of the data in pseudo form or in aggregate form (cumulative form) for example, represents a lawful form of data use for the purpose of marketing or other business or technical analyses of LIP Bled, d.o.o.

Based on its lawful interest, LIP Bled,d.o.o. may process your data also for the purpose of direct marketing (related to the customers), for preventing abuse, for enforcement of claims or for defense against the claims in administrative or statutory procedures.

Data retention periods

 Data collected by the Website administrator is retained for the use by the administrator in accordance with the terms and purposes specified in this Privacy Policy. Personal data is stored on the Website (as enquiries or contact forms) and in cases of additional processing and communication with the user, on related other databases of the company (such as CRM, software for merchandise management etc.). 

Data retention periods may differ and may be subject to regulation of specific sector legislation (e.g. accounting, tax). Different sector legislation provides for different mandatory retention periods which require LIP Bled d.o.o. to delete personal data after the expiry of the data retention period.  

As a user, you have the right to your data review and to the processing of your data by authorized processors, by submitting written request to LIP Bled, d.o.o. Customers, interested parties and their associates, management and other employees

We will not store the data any longer than necessary for the fulfillment of our contractual and statutory obligations and/or for the resolution of potential compensation claims.

If you are our customer, passed customer, enquirer or potential future customer or its contact person, your data will be stored for the purpose of marketing activities until you object or cancel your consent, in case your consent was obtained for the marketing purposes.

Suppliers

Your information will be deleted when the data is not needed anymore for the purpose it was originally collected, or when the deletion of such data is mandated by law. Request for data deletion does not apply to the data used for payment settlements and bookkeeping purposes.

Employment candidates

By submitting the employment application, you authorize the employees of Human Resource department and related departments of LIP Bled, d.o.o. to have access to your data during the application process and for additional 3 years after. All stakeholders are explicitly obligated to protect the confidentiality of the data. If you want to revoke your consent, it is sufficient to send us an e-mail to lipbl@lip-bled.si stating the related intent.

We reserve the right to delete your data at any time, without consultation with you or stating the reason.

Data users

LIP Bled, d.o.o. hereby commits not to sell, lease or trade your personal data. Your personal data will not be sent or transferred to a third country or an international organization, unless so mandated by law or the legislation of the European Union (mandates from courts, prosecution entities etc.).

In the scope of our legal rights, your data may be disclosed to:

• Service providers of information technology, in the scope of their service and maintenance of the hardware and software, where your data is being stored
• Administrator of the Website
• In some cases, the service providers (third parties) providing us with the access to the Website, development of applications, hosting, maintenance and security backups, archiving, virtual infrastructure, payment processing and other services for which they may require the access to or the use of the data.

In some cases (for example re-marketing) the administration of the data is with the third parties who transmit such data to us, based on their privacy policy.  As users, you can manage your own data and information and control the scope of data and information we obtain from the third parties (for example the social media) by using the appropriate privacy settings in your user accounts with these third parties. LIP Bled, d.o.o. is not responsible for what third parties do with your personal data and we recommend that you use the trusted applications and that you have the appropriate privacy settings for personal data protection set up with them.

The Website is also using the re-targeting technology, which enables us to address the users who showed interest in our products in the past, by targeting them through the ads placed on the websites of our partners. Re-targeting advertising tools are activated by the cookies on the product page when you open it on the website.

The websites of LIP Bled, d.o.o. have external links to the websites not under control of LIP Bled, d.o.o. By visiting these websites, you may be submitting your personal data to the third parties, with whom LIP Bled, d.o.o. doesn’t have a contract regarding the personal data processing. These websites have their own privacy policy on which they base their personal data processing. We recommend that you read their privacy policy and inform yourself about how your personal data is processed when you visit these third-party websites. 

Consent

The personal data obtained by the administrator by your use of the Website or you provide by submitting any forms from any of our websites or by subscribing to the newsletter or other e-notices, is processed with your explicit and unequivocal consent based on article (6) (1), (a) of the EU General Data Protection Regulation (GDPR).

You consent to the personal data processing by LIP Bled, d.o.o. when using the Website and clicking “Submit” on the web forms. The administrator will provide an option for your consent whenever necessary without the confirmation window.  User's personal consent is the exercise of their free will that their personal data can be processed for a certain purpose, based on information provided and guaranteed by the administrator in this privacy policy.

In addition, the user specifically agrees, without limitations, with his personal data being processed for the purpose of pre-contractual processes and contract conclusion and fulfillment, as well as, without limitations, for post-contract processes.

In such a case, we will not use your personal data for purposes described in the above paragraph anymore. Such withdrawal of consent does not affect the legality of the processing of your personal data prior to your withdrawal.

If you are our customer, it is necessary for us to process your data in order to execute and fulfill the contract with you; Paragraph (1), Line (b) of Article (6) of General Regulation (EU) 2016/679 for data protection – “GDPR”

If you are an interested party or a potential future customer, we will use your data for the purpose of direct marketing such as sending you e-mails or contacting you by phone, only in accordance with your consent as defined in paragraph (1), line (a) of Article (6) of General Data Protection Regulation (GDPR). However, as a general principle, the processing of your data is necessary based on our prevailing statutory interest to achieve the goals as defined in Pt. (1.a) Line (f) Paragraph (1) of Article (6) of GDPR.

Suppliers

Data processing is performed based on Paragraph (1), Line (b) of Article (6) of GDPR (for the preparation and execution of the contract). To fulfill the contract, as your client, to your satisfaction, it is necessary for us to process your data accordingly. 

Employment candidates 

By submitting your employment application, you have granted us your consent to process your data in accordance to Paragraph (1), Line (a) of Article (6) of GDPR (consent). 

Transfer of personal data 

There may be situations, based on a certain sales policy, when LIP Bled, d.o.o. cannot provide the most suitable offer to the customer. In such cases, we may transfer the personal data to our partner companies, associated with us on the business level.

Customers, interested parties and their associates, management and other employees

When absolutely necessary for the purposes as defined in Paragraph (1) of the article Purpose of Data Processing of this Policy, we may transfer your data to the following entities:

• Customers, in case of the data relating to associates, management or other employees of the said customer
• Other entities, designated by the customer (e.g. companies in its group)
• Other entities, selected by LIP Bled, d.o.o. for the purpose of the order fulfillment, when LIP Bled, d.o.o. cannot fulfill the order by itself, due to its contractual partner obligations.

Some of the above- mentioned entities may be located outside of the European Union, meaning that your data is processed outside of the EU. It is possible that the level of data protections in third countries is not the same as in the European Union. Because of that, we have implemented all necessary measures to ensure that all of the data recipients provide the appropriate level of data protection.

When necessary for the purposes, specified in Paragraph (1) (b) of the Article Purpose of Data Processing in this Policy, we may transfer your data to the following entities:

• Banks that we authorized to manage our payment processing

Financial and bookkeeping data may be transferred to our third- party service providers, responsible for the preparation of our accounting, financial and tax reports and filings.

In accordance with the current law and the EU's General Data Protection Regulation (GDPR), you have the right to access, amend, delete (the right to be forgotten), and port your data and restrict the processing of your data and have the right to object at any moment.
